DigiDiwali

Terms of use

Last updated 3 November 2026

These terms govern your use of DigiDiwali at digidiwali.com ("the site", "we", "us"). By visiting the site or making a payment you agree to them. If you do not agree, do not use the site.

1. What you are buying

When you "light a diya" you purchase a digital display spot on a map hosted on this site: a marker placed by the pincode you enter, shown with the name, dedication and message you type, plus a downloadable image. That is the whole product. Specifically:

2. Sabse Bada Diya

The "Sabse Bada Diya" is a display feature: the site shows, in a prominent position, the diya with the highest single payment at that moment. Any later higher payment replaces it immediately and automatically. Holding the position carries no reward, entitlement, refund, or compensation, and it may end at any moment, including seconds after it was obtained. We may reset, pause, hide or remove the feature at any time.

3. Prices and payments

Prices are in Indian Rupees and are inclusive of applicable taxes. The minimum is ₹1; you choose any higher amount. Payments are processed by Razorpay; we never see or store your card, UPI or bank details. A diya is shown only after the payment is confirmed. Your payment is final subject only to the refund policy.

4. Children's fund

We have voluntarily committed to set aside 50% of the amounts collected on this site to help underprivileged children in India, and to send it to charities, NGOs, schools or other organisations selected solely by our team, at our sole discretion. This is a commitment by us about how we use our own revenue. It does not make your payment a donation, does not create any trust, agency, fiduciary or contractual duty towards you, and gives you no right to direct, audit, claim, or enforce the use of any amount. Figures shown on the site (including the counter) are indicative amounts set aside, not statements of disbursement, and may be rounded. We may change the percentage, the recipients, or the timing, and will reflect material changes on the About page.

5. Your content

Names and messages you submit are displayed publicly, immediately, to anyone, and may appear in share images, link previews, lists and search results. You confirm you have the right to use the name you submit and that your content is not unlawful, defamatory, obscene, hateful, harassing, threatening, political or religious campaigning, commercial advertising, spam, or personal information about any other person. We filter automatically and moderate by hand; we may edit, hide or delete any content, and hide or remove any diya, at any time, for any reason, without notice and without refund. You grant us a worldwide, royalty-free, perpetual licence to display and reproduce the content you submit in connection with the site. To request removal of your own content, email us with the diya link.

6. Acceptable use

You must be 18 or older, or use the site with a parent's or guardian's permission. Do not interfere with the site, scrape it, automate payments, use stolen payment instruments, attempt to manipulate counters or positions, or use it for any unlawful purpose. We may block access, cancel orders and hide content to protect the site and its users.

7. Availability, changes and ending the site

The site is a seasonal project. We aim to keep it live through Diwali 2026 but provide it "as is" and "as available", with no promise of uptime, accuracy of counters, real-time updates, or continued operation. We may change, suspend, or shut down the site, any feature, or the display of any diya at any time, including after the festival, without notice. When the site is taken down, every digital spot on it ends with it, and no refund or compensation is due.

8. No warranties

To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Map boundaries are shown as published by the Survey of India for display purposes only.

9. Limitation of liability

To the fullest extent permitted by law, we (and our team, contractors and service providers) are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of data, goodwill, profit or opportunity, arising from or related to the site, your purchase, or any content on it, even if advised of the possibility. Our total liability to you for any claim is limited to the amount you paid us for the specific diya giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your content, your use of the site, or your breach of these terms.

11. Third parties

Payments are handled by Razorpay under its own terms. Sharing uses WhatsApp, your device's share sheet, and other third-party services we do not control.

12. General

These terms are governed by the laws of India. Subject to applicable consumer law, the courts at New Delhi have exclusive jurisdiction. If any part of these terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. We may update these terms; the date above shows the latest version, and continued use means acceptance. These terms, the privacy policy and the refund policy are the entire agreement between you and us.
